The Supreme Court of India on Monday distanced itself from the controversial changes made to Form 6, used for new voter registrations during the Special Intensive Revision (SIR) of electoral rolls across several States.

Chief Justice of India Surya Kant, heading a three‑judge Bench, categorically stated, “We are making it clear, any modifications to Form 6 have not been made by us.” The Court shifted scrutiny to the Election Commission of India (ECI), which has faced criticism for introducing new requirements in the enrolment process.

Justice Joymalya Bagchi further observed that while protections for officials in office are understood, the post‑retirement immunity granted to the Chief Election Commissioner (CEC) under the 2023 law is questionable. He noted that even judges are not given such immunity, citing the Judges Inquiry Act as an example.

The remarks come amid mounting opposition protests and petitions challenging the ECI’s functioning under CEC Gyanesh Kumar, with critics alleging that the changes disenfranchise millions of voters. The Court’s clarification underscores its intent to separate judicial responsibility from administrative decisions taken by the poll panel.
