The Supreme Court of India has agreed to consider an application seeking the recall of its September 23 split verdict in the case challenging the law governing the appointment of Election Commissioners.
The application was orally mentioned before Chief Justice of India Surya Kant by senior advocate Gopal Sankaranarayanan, who raised concerns about judicial transparency. It questioned why Justice Satish Chandra Sharma, one of the judges on the Bench, did not disclose during proceedings that his son was serving as a standing counsel for the Election Commission of India (ECI).
The plea argues that such a connection should have been revealed to avoid any perception of bias, especially in a case involving the ECI’s independence and credibility. The issue has gained traction following media reports that highlighted the familial link after the verdict was delivered.
The September 23 ruling had produced a split outcome, intensifying debate over the constitutional validity of the appointments law. With the recall application now under consideration, the apex court faces renewed scrutiny over judicial accountability and the integrity of its decision‑making process.
The matter is expected to be listed for hearing soon, potentially reopening one of the most closely watched cases in India’s electoral framework.
