The Food Safety and Standards Authority of India (FSSAI) has initiated legal action against Nestle India Ltd over alleged non-compliance with food safety regulations involving three infant nutrition products.
The food safety regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula, along with promotional material for the products available on e-commerce platforms.
FSSAI has sought clarifications from Nestle India regarding certain claims made in connection with ‘5HMOs’ and ‘Whey Protein’ in the products.
The action follows an examination of both the infant nutrition products and their promotional material. The regulator’s review indicates that compliance was assessed not only based on the products themselves but also on how they were presented and promoted to consumers.
Infant nutrition products are subject to food safety and regulatory requirements because they are intended for infants and young children. Claims made about their nutritional composition and benefits therefore come under regulatory scrutiny.
FSSAI said the action relates to alleged non-compliance with applicable food safety norms. The authority has sought further clarification from Nestle India regarding the claims under review.
The development comes as food safety authorities continue to examine compliance in packaged food and nutrition products sold through both physical and online retail channels.
At this stage, the regulatory action concerns the products and claims identified by FSSAI. Further details on the authority’s findings and Nestle India’s response will depend on the clarification process and subsequent regulatory proceedings.
