The Food Safety and Standards Authority of India (FSSAI) has issued notices to Nestlé India and Zydus Wellness over allegedly misleading claims and promotional material for selected nutrition products. The regulator has asked both companies to provide scientific evidence supporting the claims used in product labelling and advertisements.
In a notice concerning Lactogen Pro 1 Powder, FSSAI questioned Nestlé India's claim that the product contains whey protein that is easy to digest. The company has been asked to submit scientific evidence supporting the statement.
The regulator also raised concerns about Nan Excella Pro Stage 1. It questioned the claim that five human milk oligosaccharides (HMOs) help support the normal immune system, saying the wording could imply a specific physiological benefit that may not be permitted under applicable regulations. FSSAI also sought evidence supporting the product's whey protein claim.
Separately, Zydus Wellness received a notice concerning advertising and labelling claims for Complan. The regulator flagged statements including "2X Faster Growth", "Supports Concentration and Memory" and "Pro Immunity + 34 Vital Nutrients". It also questioned the advertising phrase "Growth Comes in 4 Flavours".
FSSAI has sought scientific justification for the claims and directed the company to explain why regulatory action should not be initiated under the Food Safety and Standards Act, 2006, and related regulations.
The notices form part of regulatory scrutiny of claims made about nutrition products, particularly those marketed for infants and children. Food-related advertising claims must comply with applicable safety and labelling requirements and be supported by appropriate evidence.
The notices seek explanations and supporting documentation; they should not be interpreted as final findings of liability against either company.
